2. Minimum Age Requirement and Content Warning

3. User-Generated Content (UGC) and License
UGC Responsibility: You are solely responsible for any content you generate, submit, post, or display on or through the Service (“User Content”).
Zero Tolerance Policy: You agree not to upload, post, or transmit any User Content that is illegal, defamatory, promotes real abuse, or violates any third-party rights. Violations will result in immediate account termination and potential reporting to law enforcement.
Grant of License to Hentai Studio: By submitting User Content, you grant Hentai Studio a perpetual, worldwide, non-exclusive, royalty-free, transferable license to host, store, use, display, reproduce, modify, adapt, publish, and distribute your User Content for the purpose of operating, improving, and promoting the Service.
Waiver of Moral Rights: You waive any and all moral rights (droit moral) you may have in the User Content.
4. Intellectual Property and AI Generation
AI Art Disclaimer: You acknowledge that the legal status of copyright for AI-generated images is uncertain globally. While we note U.S. judicial precedent (such as Thaler v. Perlmutter) that AI-generated images may lack human authorship, the enforceability of copyright is governed by the laws of the jurisdiction where the project developer is located.
No Copyright Claim on UGC: Hentai Studio does not claim ownership or copyright over the AI-generated User Content you submit. You retain all rights to your User Content, subject to the license granted in Section 3.
Prohibited AI Data Mining: You are strictly prohibited from using any automated or manual process (including bots, scrapers, or AI models) to extract data, content, or materials from the Service for the purpose of training third-party AI models, data mining, or commercial reproduction without express written consent.
5. Termination and Enforcement
Hentai Studio reserves the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms, violate the law, or infringe upon the rights of others.
6. Disclaimer of Warranties and Limitation of Liability
Platform Status: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied.
Limitation of Liability: In no event shall Hentai Studio, nor its owner, directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any unauthorized access, use or alteration of your transmissions or content.
7. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the jurisdiction where the project developer is located, without regard to its conflict of law provisions.
You agree that the courts of the jurisdiction where the project developer is located shall have the exclusive primary jurisdiction to resolve any dispute, controversy, or claim arising out of or relating to these Terms or the Service.
